Shiv Sena Symbol Dispute: Supreme Court to Hear UBT Faction’s Plea on July 14 Before Maharashtra Elections

The Supreme Court lists July 14 as the date for the Shiv Sena’s (UBT) urgent hearing on the symbol dispute ahead of the Maharashtra local elections.

On Wednesday, July 2, the Supreme Court agreed to list on July 14 an application filed by Uddhav Balasaheb Thackeray’s Shiv Sena, which was contesting the Election Commission of India’s decision to recognize the Eknath Shinde group as the official Shiv Sena and give them the “bow and arrow” election symbol. The petition sought interim relief.

In front of a partial working days bench made up of Justices MM Sundresh and K Vinod Chandran, Senior Advocate Devadatt Kamat spoke on behalf of the UBT group and requested an urgent listing for this week or next week.

Nevertheless, during the partial working days, the bench was not inclined to list the subject. When the identical reference was made on May 7, the Shiv Sena’s attorney, Eknath Shinde, argued that the bench of Justice Surya Kant had denied the request for an urgent hearing.

However, Kamat claimed that the issue had been permitted to be brought up over the holidays by Justice Kant’s bench. Kamat noted the urgency of the upcoming Maharashtra local body elections, which will be announced in accordance with the Supreme Court’s May 6 judgment. According to him, the application was submitted in order to get temporary arrangements that were comparable to those that the court had mandated in the NCP dispute. The Ajit Pawar group was ordered by the Supreme Court to publicize that their usage of the official insignia was a subjudice matter in the NCP dispute.

However, Justice Sundresh stated that he was not interested in listing the case during the half working days. In response to Justice Sundresh’s question about the urgency, Kamat stated that it had to do with the people’s right to make their own decisions. In the end, Kamat successfully convinced the bench to schedule the matter for July 14, the day the Court reopens for regular sessions.
